The processing carried out by VICAT on the Site concerns both visitors to the Site and users wishing to use the Services offered on the Site (collectively the "Users").

Your Personal Data is collected directly from you when you use the Services, particularly when you request information about our business, products, or services, subscribe to our newsletter, or seek to contact us.
VICAT may also collect your Personal Data when you use or browse the Site via browser cookies. Technical information (such as IP address or browser details) is also transmitted to VICAT by your device when you visit or use the Site.

6. WHAT ARE THE FLOWS OF PERSONAL DATA?

Access to your Personal Data is strictly limited to:

  • Authorized VICAT employees, due to their roles, who are bound by a confidentiality obligation;

  • VICAT’s subcontractors, contractually tasked with performing the duties necessary for the proper functioning of the Site and Services, including cloud storage for the Site and your Personal Data.

VICAT may also disclose your Personal Data to judicial or administrative authorities, or any other organization, if required by law.

We will always do our best to ensure that third parties with whom we share your Personal Data are subject to confidentiality and security obligations in accordance with our Privacy and Cookies Policy and applicable laws. We only allow them to process your Personal Data for specific purposes and according to our instructions.

Except as expressly indicated above, we will never share, sell, or rent your Personal Data to any third party without informing you and/or obtaining your consent. If you have given us your consent to use your information in a specific way but later change your mind, you must contact us to inform us of this change, and we will cease to do so.

7. PROCESSING OF DATA OUTSIDE THE EUROPEAN UNION

VICAT does not transfer Personal Data outside the European Union to countries that have not been subject to an adequacy decision by the European Commission under Article 45 of the GDPR, or without standard contractual clauses, as adopted by the European Commission, having been concluded and accompanied by appropriate measures.

8. RETENTION PERIOD FOR YOUR PERSONAL DATA

We will only retain your Personal Data for as long as necessary to fulfill the purposes for which we collected it, including to meet any legal or regulatory requirements.

To determine the appropriate retention period for your Personal Data, we consider the amount, nature, and sensitivity of your Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, as well as the applicable legal requirements.

We retain your Personal Data for the following periods:

  • Claims and complaints: 3 years after a claim or complaint has been closed;

  • Questions or registrations via a contact form: 3 years from your request and as long as the User does not unsubscribe or from the last contact;

  • Newsletter subscription: 3 years as long as the User does not unsubscribe or from the last contact.

After these periods, the data is either deleted or anonymized, particularly for statistical purposes. However, they may be retained if required for pre-litigation or litigation purposes. Deletion or anonymization is irreversible, and VICAT will no longer be able to restore the concerned data.

9. USERS' RIGHTS REGARDING PERSONAL DATA

As a User, you have the following rights, which are not absolute and are subject to certain conditions described below, in accordance with the Regulations:

  • The right of access: You have the right to obtain confirmation from us as to whether your Personal Data is being processed by us, as well as other information specified in our Privacy and Cookies Policy about how it is used. You also have the right to access your Personal Data by requesting a copy of the Personal Data we hold about you, if applicable. This allows you to know and verify that we are using your information in accordance with the Regulations. However, we may refuse to provide information if it may reveal Personal Data about another person or negatively affect another person's rights.

  • The right to rectification: You can ask us to correct your Personal Data if it is inaccurate or incomplete (for example, if your name is misspelled or your address is incorrect).

  • The right to erasure: Also known as the "right to be forgotten," this right allows you to request the deletion or removal of your Personal Data where, for example, there is no compelling reason for us to continue using it, or its use is no longer in line with the Regulations. This right has some exceptions, such as when we need to use this information for legal proceedings or to comply with a legal obligation.

  • The right to restrict processing: You have the right to "block" or prevent the further use of your Personal Data when we are considering a rectification request or as an alternative to erasure. When processing is thus restricted at your request, we may still store your Personal Data in accordance with the Regulations but may not use it further.

  • The right to data portability: You have the right to obtain and reuse certain Personal Data for your own purposes across different companies (which are separate data controllers). This only applies to the Personal Data you have provided to us, which we process by automated means with your consent as part of the use of the Site and/or Services. In this case, we will provide you with a copy of your Personal Data in a structured, commonly used, and machine-readable format, or we will transmit your Personal Data directly to another data controller that you specify, if technically feasible.

  • The right to object: You have the right to object to certain types of processing, for reasons related to your particular situation, at any time, to the extent that such processing takes place for the purposes of legitimate interests pursued by VICAT.   • The right to withdraw your consent: Where we process your Personal Data based on your consent, you have the right to withdraw your consent at any time. However, such withdrawal does not affect the lawfulness of the processing that occurred before the withdrawal.

  • The right to provide instructions on the use of your Personal Data after your death: In France, you have the right to provide instructions on the management (e.g., retention, erasure, and disclosure) of your Personal Data after your death. You can modify or revoke your instructions at any time.

Exercising your rights will incur no cost for you. However, we will not be obliged to comply with your request if it is manifestly unfounded or excessive.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Data or exercise any of your other rights. 11. HOW IS DATA SECURED?

VICAT ensures that Personal Data is processed securely and confidentially, including when some of these processes are carried out by subcontractors. To this end, we have implemented technical and organizational measures to prevent the loss, misuse, alteration, or deletion of your Personal Data. These measures are adjusted according to the sensitivity level of the data processed and the risk level presented by each process or its implementation. We have established procedures to handle any suspected data security breaches, and we will notify you and any relevant supervisory authority of any such breach when we are legally required to do so.

13.1. What are cookies?
